Comprehensive Terms of Service and End User License Agreement (EULA)

Welcome to Apollo AI ("Company," "we," "our," or "us"). These Comprehensive Terms of Service and End User License Agreement ("Terms") govern your access to and use of the Apollo AI mobile application, website, software, and any related services (collectively, the "Platform").

By downloading, accessing, registering an account, or purchasing any tier or access pass to the Platform, you ("User," "Tutor," or "you") expressly acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must immediately cease all use of the Platform and uninstall the application.

We reserve the right, at our sole discretion, to modify, alter, or otherwise update these Terms at any time. Your continued use of the Platform following the posting of modifications constitutes your acceptance of such changes.

2.1. Age Requirement: You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction of residence, to use the Platform. By using the Platform, you represent and warrant that you meet this requirement.

2.2. Account Creation: To access the earning features of the Platform, you must create an account using a valid email address. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3. Accuracy of Information: You agree to provide current, complete, and accurate information during the registration process and to update such information as necessary. We reserve the right to suspend or terminate your account if any information provided proves to be false, inaccurate, or incomplete.

3.1. Platform Purpose: Apollo AI operates strictly as an intermediary platform providing gamified Reinforcement Learning from Human Feedback (RLHF) micro-tasks.

3.2. No Employment Relationship: Your participation on the Platform does not constitute an employment, agency, partnership, or joint venture relationship between you and Apollo AI, nor between you and any third-party artificial intelligence companies (e.g., "Big Techs"). You act solely as an independent user participating in a gamified environment.

3.3. Tax Liabilities: You are solely responsible for calculating, reporting, and remitting any applicable taxes to the relevant tax authorities (such as the IRS) arising from any eventual payouts you may receive from the Platform.

4.1. The Visual Balance: As you complete RLHF tasks, the Platform will display a "Visual Balance" (e.g., in USD format). You expressly acknowledge and agree that this Visual Balance is a gamified internal scoring metric only. It does not represent real fiat currency, it is not held in a bank account on your behalf, it does not accrue interest, and it possesses no cash value outside of the specific withdrawal parameters defined herein.

4.2. Account Tiers (Standard, VIP, UltraVIP): The Platform operates on a tiered system. Your daily task limits, the frequency of higher-paying tasks, and the specific withdrawal thresholds are strictly governed by your active Account Tier. We reserve the right to modify the parameters of these Tiers at our sole discretion.

4.3. Daily Task Limits: To ensure the integrity of the data provided to our AI partners, the Platform imposes strict mathematical caps on the number of tasks a User can complete within a rolling 24-hour period. You cannot bypass these limits to artificially accelerate your Visual Balance.

5.1. Threshold Requirements: Payouts are not guaranteed and are strictly contingent upon the User completing a comprehensive "Work Batch." You may only request a withdrawal once your Visual Balance reaches the exact minimum threshold stipulated for your specific Account Tier (Standard, VIP, or UltraVIP).

5.2. Prohibition of Partial Payouts: Under no circumstances will Apollo AI process partial withdrawals, advance payments, or pro-rated payouts based on time invested if the precise Tier threshold has not been met. The intrinsic value of the data generated relies on complete, validated batches. Failure to reach the designated threshold means the batch is incomplete and holds zero commercial value to Apollo AI.

6.1. Access Fees and Upgrades: Access to the Platform or specific Premium Tiers may require an initial purchase, license fee, or subscription. Refund requests for these purchases are subject to the specific timeframes and policies established by the third-party payment gateway used at checkout.

6.2. Forfeiture Clause: IT IS EXPRESSLY AGREED AND UNDERSTOOD THAT IN THE EVENT A USER INITIATES A REFUND REQUEST, CHARGEBACK, OR DISPUTE FOR THE PURCHASE PRICE OF THE PLATFORM ACCESS OR TIER UPGRADE, SUCH ACTION CONSTITUTES A UNILATERAL TERMINATION OF THIS AGREEMENT BY THE USER. CONSEQUENTLY, ANY AND ALL "VISUAL BALANCE" ACCUMULATED IN THE USER'S ACCOUNT UP TO THAT EXACT MOMENT SHALL BE IMMEDIATELY, AUTOMATICALLY, AND IRREVOCABLY FORFEITED, VOIDED, AND CANCELLED. By requesting a refund, the User voluntarily abandons their incomplete Work Batch and waives any and all rights to claim compensation for tasks completed prior to the refund request.

7.1. Prohibited Activities: You agree not to: (a) use automated scripts, bots, macros, or any unapproved software to complete tasks; (b) use Virtual Private Networks (VPNs) or proxies to mask your location or create multiple accounts; (c) provide intentionally false, random, or low-quality feedback on tasks; (d) reverse engineer, decompile, or disassemble the Platform; (e) sell, rent, or transfer your account to a third party.

7.2. Enforcement: Apollo AI employs automated fraud detection systems. We reserve the right to permanently ban your account, withhold payouts, and void your Visual Balance without prior notice if our systems detect any violation of Section 7.1.

All content, design, code, graphics, algorithms, and interfaces comprising the Platform are the exclusive property of Apollo AI and are protected by international copyright, trademark, and trade secret laws. Furthermore, all data, feedback, and inputs generated by you during the completion of RLHF tasks become the sole and exclusive property of Apollo AI immediately upon submission.

THE PLATFORM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. APOLLO AI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. RESULTS AND EARNING POTENTIALS MAY VARY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APOLLO AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE PLATFORM, REGARDLESS OF THE LEGAL THEORY ASSERTED.

11.1. Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or the use of the Platform shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, rather than in court.

11.2. Class Action Waiver: YOU AND APOLLO AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms shall remain in full force and effect. These Terms constitute the entire agreement between you and Apollo AI regarding the use of the Platform.

13.1. No Guarantee of Income: Apollo AI strictly complies with Federal Trade Commission (FTC) guidelines regarding income claims. We affirmatively declare that we make NO GUARANTEES whatsoever regarding your ability to earn money, reach specific thresholds, or successfully withdraw funds using our Platform. The figures stated in our marketing materials, advertisements, or onboarding screens (e.g., "$5,453.25 potential") are purely illustrative, represent mathematical maximums under perfect conditions, and do NOT represent the average User's experience.

13.2. Atypical Results and Testimonials: Any testimonials, case studies, or examples of earnings depicted on our website or promotional materials represent exceptional results achieved by highly dedicated Users operating, in most cases, under Premium Tiers (VIP or UltraVIP). These results are atypical and cannot be construed as common, expected, or normal. Your individual results will vary significantly based on numerous factors, including but not limited to: your Account Tier, your daily task completion rate, the accuracy of your feedback, market demand from Big Tech partners, and your personal perseverance in reaching the required Tier threshold.

13.3. Business Risk: Purchasing an Account Tier, upgrade, or access pass is a transaction, not an investment. You accept the inherent risk that you may not earn back the money spent on your initial purchase or upgrades. You should operate under the assumption that if you fail to reach your specific Tier's withdrawal threshold, your net financial outcome will be zero. You should only spend money that you can afford to lose.

13.4. Not Professional Advice: Apollo AI is a software provider, not a financial advisor, employer, or legal counsel. Nothing communicated by us constitutes financial or career advice. You assume all risks associated with your use of the Platform and your pursuit of the Visual Balance thresholds.

At Apollo AI (apollosystem.org), we want you to be fully satisfied with your purchase. However, due to the digital nature of our gamified RLHF platform and the proprietary architecture of our Account Tiers, we enforce a strict and transparent refund policy. By purchasing any access pass, license, or Tier upgrade, you explicitly agree to the terms outlined below.

We offer a 14-calendar-day money-back guarantee on initial purchases. If you are not satisfied with the Apollo AI Platform, you may request a full refund within exactly fourteen (14) calendar days from the original timestamp of your transaction. To initiate a refund within this window, you must send an email to support@apollosystem.org from the exact email address used during registration. Refund processing may take up to 30 business days depending on your bank or credit card issuer.

Once the 14-calendar-day guarantee period has expired, all sales are considered final. Apollo AI reserves the sole and absolute right to firmly deny any and all refund requests submitted after this period. In highly exceptional circumstances, reviewed strictly on a case-by-case basis, Apollo AI may, at its sole discretion, offer a partial refund accounting for server costs, data processing fees, and the duration of your account usage. This is a courtesy, not an obligation.

As stipulated in our Terms of Use, requesting a refund constitutes a unilateral termination of your active Work Batch. By initiating any refund request, you immediately, automatically, and irrevocably forfeit all "Visual Balance" (unpaid earnings) accumulated in your Apollo AI account. Once a refund is processed, your account balance is permanently zeroed, and you waive any right to claim compensation for tasks completed.

During the refund request process, our support team may occasionally offer you a complimentary account upgrade (e.g., a free transition to a VIP or PRO Tier) or alternative compensation as a courtesy to improve your experience and earnings potential.

Crucial Condition: If you explicitly accept this promotional offer or free upgrade to continue using the Platform, you permanently waive and surrender any remaining days on your 14-day money-back guarantee. By accepting the retention offer, your purchase becomes immediately non-refundable, and no future refund requests will be entertained under any circumstances.

We maintain a zero-tolerance policy against friendly fraud or unjustified chargebacks. If you file a chargeback dispute with your bank or credit card company without first contacting support@apollosystem.org and allowing us the standard 48–72 hours to resolve the issue, we will consider it a breach of contract. In such events, your account will be permanently banned, your IP address will be blacklisted across our network, and we will submit evidence of your Platform usage and this agreement to your bank to contest the dispute.

The information, services, and gamified tasks provided by Apollo AI through apollosystem.org (the "Platform") are offered strictly on an "as-is" and "as-available" basis. By accessing the Platform, you acknowledge that participating in Reinforcement Learning from Human Feedback (RLHF) micro-tasks is an independent, dynamic activity subject to market forces, and not a traditional employment opportunity or guaranteed income stream.

As detailed in our Terms of Use, Apollo AI operates on a strict batch-completion model.

No Fiat Value Until Threshold is Met: The "Visual Balance" displayed in your dashboard is a gamified, internal tracking metric. It does NOT represent real fiat currency stored in a bank account, nor does it constitute a debt owed to you by Apollo AI.

Locked Funds Liability Waiver: You explicitly understand and agree that you have zero legal claim to the Visual Balance until the exact mathematical threshold of your specific Account Tier (Standard, VIP, or UltraVIP) is successfully reached. If you stop using the Platform, are banned for violating our Terms, or simply fail to reach the threshold, your balance will remain indefinitely locked and will eventually be forfeited. You agree to hold Apollo AI completely harmless and waive any right to litigate, sue, or dispute "locked" or "unreachable" balances.

The Apollo AI ecosystem is entirely dependent on the data needs of third-party Artificial Intelligence companies. Therefore, task mechanics are highly volatile.

Decreasing Task Values: The financial reward attached to individual tasks is dynamically priced based on real-time market Supply and Demand. As more users (Tutors) join the Platform, the supply of human feedback increases, which may result in a reduction of the payout per task over time.

Task Availability: We make absolutely no guarantees regarding the daily volume of tasks available to you. On certain days, task availability may be abundant; on other days, it may be scarce or zero. Apollo AI cannot be held liable if a lack of available tasks delays or prevents you from reaching your Tier's withdrawal threshold.

Any income representations, earning potentials, or visual examples presented on apollosystem.org, in our advertisements, or by affiliates are purely illustrative estimates based on maximum mathematical efficiency under perfect market conditions.

Past Performance is Not Indicative of Future Results: The fact that a specific user, or a group of Premium Tier users, achieved high earnings or reached their withdrawal threshold in the past provides no guarantee, promise, or implication that you will achieve the same or similar results.

Individual Variables: Your success depends entirely on uncontrollable variables, including your Tier level, daily consistency, task accuracy, and the global demand for AI data at the time of your participation. You accept the risk that your financial outcome may be zero.

Apollo AI is a technology platform connecting human feedback to AI systems. We are not financial advisors, investment brokers, or employment agencies. Purchasing an Account Tier or access pass should be viewed strictly as a software transaction, not an investment. You must conduct your own due diligence and assume all risks associated with your purchase and time spent on the Platform.
